The following general terms and conditions (GTC) of the following provider apply to all online orders:

These General Terms and Conditions (GTC) apply to all services offered by Oh, you pretty things, Blüemli Morgen, based in Basel, Switzerland, (hereinafter "Blüemli Morgen"). By using Blüemli Morgen's services, you accept the following conditions unchanged and in full.
Order

The order is placed through the online shop via ohyouprettythings.ch from Blüemli Morgen.
Every order at ohyouprettythings.ch is binding.
By placing an order, the customer concludes a valid purchase contract with Blüemli Morgen and undertakes to pay for the goods and accept them. Every order and status change is communicated to the customer by email. By clicking on the General Terms and Conditions field during the ordering process, the customer confirms that he has read the General Terms and Conditions and accepts them in full.
Availability

Blüemli Morgen cannot guarantee the complete availability of the offer. Despite order confirmation, it may happen that ordered products can no longer be delivered. If the goods are not in stock, Blüemli will inform you by email of the next possible delivery date. Partial delivery is possible and any additional delivery costs resulting from the partial delivery will be borne by Blüemli Morgen.
In the event of a severe delay in delivery, the customer has the right to cancel the ordered product or switch to another product. The payment made will be refunded.
Product descriptions may differ slightly from the products on ohyouprettythings.ch. Such errors are subject to change due to manufacturer product range renewals. An exchange or claims for damages due to incorrect images, texts and prices or late delivery are excluded.
Delivery

We keep most items in stock and usually deliver them within 2 – 4 working days. We deliver within Switzerland and the Principality of Liechtenstein as well as to Germany and the rest of the world. The delivery dates we provide are to be viewed as guidelines only. A delivery date is stated to the best of our knowledge, but without guarantee. In no case do delivery delays give rise to claims for damages or the customer's right to withdraw from the purchase contract.

Prices

The final prices shown are in CHF, further details can be found on the product page.
The prices stated at the time of ordering are binding (obvious errors excluded). Price changes are expressly reserved.
Shipping and transfer of benefits and risks

There are no shipping costs for orders of CHF 60.00 or more.
For all other shipments, postage and packaging will be charged at CHF 3.00 or CHF 9.00, depending on the weight. Shipping to Germany is CHF 7.00.
Deliveries are sent via Swiss Post with Post Pac Priority (A-POST), in Germany as a DHL package.
The risk is transferred to the customer when the goods are handed over to the company responsible for transport.
There is also the alternative of self-collection, which is free of charge.
Payment terms

Retention of title

The goods remain the property of Blüemli Morgen until the purchase price and all additional claims have been paid in full. Blüemli Morgen is entitled to have the retention of title entered in the relevant register.
Exchange, return of goods, notification of defects

Return Policy / Defects
For hygiene reasons, it is not possible to exchange or return opened products. If you have any questions about an item, please contact us before purchasing, we will be happy to advise you. If the delivered goods differ from the order or have defects, please inform us by email within 3 working days of delivery of the goods; after the 3rd working day the goods are deemed to have been accepted without objection. After you have informed us, send us the goods you complained about within 1 week and we will deliver a replacement free of charge. Excluded from exchange are defects that are due to improper use. In the event of damage caused by transport, the complaint must be made within 48 hours, otherwise the right to a free replacement will expire.
The right of return only applies to unopened original packaging. The right of return begins when the customer receives the goods. This also covers the costs of the return. If you have returned the goods on time, the amount will be credited or refunded.
resignation

Blüemli Morgen is entitled to withdraw from the purchase contract if one of Blüemli Morgen's suppliers cannot deliver. The customer will be informed immediately about the unavailability of the ordered goods and any payments already made by the customer will be refunded immediately.
data protection

Blüemli Morgen does not pass on any personal customer data stored by customers in the online shop to third parties.
Excluded are data that are necessary for sending by post.
Liability
-------------------------------------------------- ----------------------
Blüemli Morgen assumes no liability for the handling and use of the delivered goods.
Place of jurisdiction and applicable law
-------------------------------------------------- ----------------------
These General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel.
General

Blüemli Morgen can change these general terms and conditions at any time without prior notice.
Severability clause
-------------------------------------------------- ----------------------
If a provision of the agreement is declared void or legally ineffective, the remaining provisions remain unaffected and are to be interpreted as if the agreement had been concluded without the invalid provision.
